Privacy Policy

Functional Medicine of Idaho (referred to as "Practice," "we," "our," or "us") is committed to protecting your privacy and securing your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws. This Privacy Policy outlines how we collect, use, and safeguard your information when you use our website and services.

By using our Website, you consent to the data practices described in this Privacy Policy. If you do not agree to these terms, please do not access or use the Website.

HIPAA & Protected Health Information (PHI)

As a healthcare provider, we are required by law to maintain the privacy of your Protected Health Information (PHI). PHI includes any health information that identifies you and relates to your past, present, or future physical or mental health or condition, the provision of healthcare, or payment for healthcare.

We will not use or disclose your PHI without your written authorization, except as permitted or required by law. When we do share information, we limit it to the minimum necessary to accomplish the intended purpose.

Sharing with Business Associates

We may share PHI with trusted third-party vendors, known as Business Associates, who perform certain functions or services on our behalf (such as billing, data hosting, or laboratory processing). These Business Associates are contractually obligated to safeguard your PHI in compliance with HIPAA and are only permitted to use or disclose your information for authorized purposes.

Patient Rights Under HIPAA

You have the following rights regarding your PHI:

  • Right to Access: You can request copies of your health records and billing information.

  • Right to Amend: You can request corrections to your PHI if you believe it is inaccurate or incomplete.

  • Right to an Accounting of Disclosures: You can ask for a list of disclosures we have made of your PHI, excluding those made for treatment, payment, or healthcare operations.

  • Right to Request Restrictions: You may request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations. While we are not required to agree, we will comply when possible.

  • Right to Request Confidential Communications: You can ask that we contact you in a specific way or send mail to a different address.

  • Right to Revoke Consent: You may withdraw your consent to any optional data uses or authorizations at any time by contacting us in writing.

  • Right to File a Complaint: If you believe your rights have been violated, you may file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.

Telemedicine Jurisdiction Compliance

We only provide telemedicine and clinical services in states where our providers are licensed to practice. Technical and administrative safeguards are in place to prevent payment processing or shipment of products to jurisdictions where we are not authorized to operate. This ensures compliance with state licensing requirements and telehealth regulations.

Submission, Storage, and Use of Personal Information

We collect personal information (such as name, email, phone number, and payment details) when you use our website or services. This information is used for scheduling, billing, and service delivery.

With your explicit consent, we may send occasional wellness-related or educational communications, which you may opt out of at any time. We do not use PHI or personal data for marketing purposes without prior authorization.

We also collect anonymous demographic and technical data (e.g., IP address, browser type) to monitor website performance and improve user experience.

All sensitive information is stored securely and encrypted where required. We retain personal and health information only as long as necessary to fulfill the purposes described in this policy or as required by law.

Information Sharing & Disclosure

We will not disclose your PHI or personal information to third parties except:

  • As required by law;

  • With your authorization;

  • To comply with legal obligations or investigations;

  • To protect your health and safety or the rights and property of others; or

  • To Business Associates performing authorized functions under HIPAA safeguards.

We do not sell, lease, or rent your personal or health information to any third party.

User Generated Content

The Services may enable you to post product reviews and other user-generated content. If you choose to submit user generated content to any public area of the Services, this content will be public and accessible by anyone.

We do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.

Third Party Websites and Links

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Use of Cookies

We may use cookies to enhance your user experience, track website performance, and personalize content. You may disable cookies in your browser settings, though this may impact certain website functions.

We do not use cookies for behavioral advertising or tracking across third-party websites.

Like many websites, we use Cookies on our Site. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites.

Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.

Children’s Privacy

Our website and services are not intended for children under 13 years of age, and we do not knowingly collect personal information from them. If we discover that information from a child under 13 has been inadvertently collected, it will be promptly deleted.

Data Retention and Security

We retain PHI and personal information only as long as necessary for treatment, legal compliance, and business purposes. We maintain administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction.
